BUSHCHAT APARTMENT – BOOKING TERMS AND CONDITIONS

These Booking Terms apply to bookings made through bushchat.co.uk for the Bushchat apartment in Sotogrande, Andalucía, Spain.

The apartment is owned by Gyr Wildlife Services Ltd and is offered on a limited seasonal basis, primarily to friends and birdwatchers who are members of the RSPB or approved birdwatching clubs and societies. It is not marketed as nightly or weekend accommodation through Airbnb-style platforms.

The accommodation and guest services in Spain are managed locally by our appointed Spanish property-management agent.

 

1. Bookings

Bookings are normally for periods of seven nights, from Friday to Friday, unless otherwise specifically agreed.

The maximum number of people permitted to stay in the apartment is four guests.

A booking is confirmed when:
1. we have confirmed the dates and price in writing; and
2. the required deposit has been received.
Following the payment of a Deposit, a link to a secure booking information form will be sent to the lead guest. We require this information for the purpose of identifying the guests using the apartment. The person making the booking must be aged 18 or over and accepts these Booking Terms on behalf of everyone included in the booking.

 

2. Prices

The price payable is the price agreed in the booking confirmation.

Prices normally include:

• accommodation for the agreed period;
• bed linen;
• towels; and
• normal use of the apartment and its facilities.

Bookings may be paid in pounds sterling or euros as agreed at the time of booking.

 

3. Deposit

A deposit of 20% of the total accommodation price is required to secure the booking.

The deposit is intended to contribute towards the administration involved in taking and processing a booking and the potential loss of rental income resulting from taking the apartment off the market for the dates reserved.

If the guest subsequently cancels, the deposit will normally be non-refundable to the extent that it represents our reasonable administration costs and actual loss arising from the cancellation.

We will, however, take reasonable steps to re-let the cancelled dates. If we successfully re-let them, we will not retain more of the deposit than is reasonably required to cover our actual loss and reasonable administration costs.

 

4. Final Payment

The balance of the accommodation price is payable six weeks before the arrival date.

If the balance is not received by the due date, we reserve the right to treat the booking as cancelled after giving the guest reasonable notice.

 

5. Cancellations by the Guest

Cancellations must be made in writing by email.

If cancellation takes place more than six weeks before arrival, the 20% deposit will normally be retained subject to the provisions in section 3 concerning our actual losses and any successful re-letting.

For cancellations made within six weeks of arrival, the full accommodation charge may be retained where we are unable to re-let the apartment.

We will always take reasonable steps to re-let cancelled dates. If we succeed in doing so, we will refund any amount received from the cancelling guest which exceeds our actual financial loss and reasonable administration costs.

Guests are strongly advised to obtain suitable travel insurance covering cancellation.

 

6. Cancellations by Us

In the unlikely event that we are unable to provide the apartment for reasons within our control, we will refund all accommodation payments made to us.

We will not be responsible for consequential losses such as flights, car hire or other travel arrangements. Guests should ensure these are appropriately insured.

 

7. Maximum Occupancy

The apartment may accommodate a maximum of four people.

Only the guests named on the booking may stay overnight unless we have agreed otherwise in writing.

The apartment must not be sublet or transferred to another person.

 

8. Arrival, keys and Departure

Check-in arrangements and instructions for obtaining the keys will be provided before arrival.

Guests must follow the instructions supplied by our local property-management agent.

The apartment must be vacated by the agreed departure time and keys returned in accordance with the instructions provided.

 

9. Care of the Apartment

Guests are expected to treat the apartment, furniture, fixtures, equipment and communal facilities with reasonable care.

Any breakage, loss or damage must be reported promptly.

Where an item has been damaged or broken through the actions or negligence of a guest, the guest will be responsible for the reasonable cost of repair or replacement.

We will provide an invoice, receipt or other reasonable evidence of the repair or replacement cost before requesting payment.

Guests will not be charged for reasonable wear and tear.

 

10. Pets

Pets are not permitted in the apartment.

 

11. Noise and Behaviour

The apartment is located in a residential development and guests must respect neighbouring residents.

Noise, television, music and other activities must be kept at a reasonable level, particularly during the evening and at night.

Parties, functions and organised gatherings are not permitted.

Guests must comply with reasonable community rules applying to the apartment and communal areas.

Serious or repeated unreasonable behaviour may result in the local agent requiring guests to leave the property.

 

12. Smoking

Smoking is not permitted inside the apartment.

 

13. Communal Facilities

Guests using swimming pools, gardens or other communal facilities must comply with the rules of the development.

Use of such facilities is subject to availability, maintenance arrangements and any rules imposed by the community or local authorities.

 

14. Personal Property

Guests are responsible for looking after their own personal belongings.

Gyr Wildlife Services Ltd cannot accept responsibility for loss or theft of personal possessions except where liability arises through our negligence and cannot lawfully be excluded.

 

15. Problems During the Stay

Any problem with the apartment should be reported promptly to the local property-management agent so that there is a reasonable opportunity to resolve it during the stay.

16. Changes Outside Our Control

We will not be responsible for matters outside our reasonable control, such as interruptions to public utilities, extreme weather, government restrictions, disruption to communal facilities or other circumstances which we could not reasonably prevent.

Nothing in these terms excludes any legal rights which cannot lawfully be excluded.

 

17. Acceptance of Terms

Payment of the booking deposit confirms that the lead guest has read and accepted these Booking Terms on behalf of all members of the party.
